Terms of use.
This English text is a translation provided for convenience. Loyhub’s legal terms are governed by French law; in case of any discrepancy, the French version prevails.
1. Purpose
These general terms of use (the "Terms") govern access to and use of the Loyhub mobile application and the loyhub.store website (together, the "Service"), published by OpexCore LLC. Loyhub brings together local businesses and their customers around loyalty programmes, offers, and social features.
2. Acceptance of the Terms
Creating an account or using the Service constitutes full and unconditional acceptance of these Terms. If you do not accept these Terms, you must not use the Service.
3. Description of the Service
Loyhub allows users to follow establishments, collect loyalty stamps, benefit from offers, publish reviews, and interact via groups and friends lists. Establishments can publish offers, manage loyalty cards, and scan their customers' stamps.
4. User account
Access to the features requires creating an account. You undertake to provide accurate information and keep it up to date. You are responsible for the confidentiality of your credentials and for all activity carried out from your account. The Service is reserved for persons legally capable of entering into contracts; minors may use it only with the consent of their legal guardian.
5. Acceptable use
You undertake not to use the Service for unlawful purposes or in breach of these Terms. The following are expressly prohibited: publishing illegal, defamatory, hateful, or misleading content; identity fraud; harassment of other users; abuse of loyalty programmes or offers; and any attempt at unauthorised access to the Service or interference with its operation.
6. User-generated content
You remain responsible for the content you publish (reviews, messages, group names, etc.) and warrant that you hold the rights to it. By publishing content, you grant Loyhub a non-exclusive, royalty-free licence to host and display that content within the Service. Loyhub may remove any content that is reported or contrary to these Terms. A reporting and blocking mechanism is available to you within the app.
7. Establishments, offers, and loyalty
Loyhub acts as a technical intermediary between users and establishments. Offers, discounts, and loyalty programmes are defined and honoured solely by the establishments concerned. Loyhub is not a party to transactions carried out in store and does not guarantee the availability or conditions of the offers displayed.
8. Paid subscriptions
Certain features intended for establishments are accessible via a paid subscription, managed by our payment provider Stripe. Subscriptions are renewed according to the chosen frequency and may be cancelled at any time from the management area; cancellation takes effect at the end of the current period. In the event of non-payment, paid features may be suspended without affecting stamps already collected by customers.
9. Intellectual property
The Service, its brand, its interface, and its code are the property of OpexCore LLC. No reproduction or exploitation, in whole or in part, is authorised without prior written consent.
10. Availability and liability
The Service is provided "as is". Loyhub uses reasonable endeavours to ensure its availability but does not guarantee uninterrupted or error-free operation. To the extent permitted by law, Loyhub shall not be liable for indirect damages arising from the use of or inability to use the Service.
11. Suspension and termination
You may delete your account at any time from the app or via the Delete account page. Loyhub may suspend or terminate an account in the event of breach of these Terms or fraudulent use of the Service.
12. Personal data
The processing of your personal data is described in our Privacy policy.
13. Changes to the Terms
Loyhub may amend these Terms to reflect changes to the Service or applicable regulations. The version in force is the one published on this page; continued use of the Service after an update constitutes acceptance of the revised Terms.
14. Governing law
These Terms are governed by French law. Mandatory provisions protecting consumers residing in France remain applicable. In the event of a dispute, you may refer the matter free of charge to a consumer mediator before taking any legal action.
